Italy Alert: Change in Termination Procedure for Resignations

By Kira Rubiano

Italy has implemented an HR regulatory change effective March 12, 2016. Celergo wants to notify you Italy_1459469113_83155that this change has an impact on your payroll/HR operations that you need to be aware of and advise your HR staff and employees.

Italy has enacted a new procedure in the case of an employee resignation or a termination due to mutual agreement. The new measure aims to discourage “white resignations,” wording used in Italy for those resignations that may be influenced by the employer.

The key to this change is that resignations will be possible only online, and the filing will need to be done directly by the employee. The filing will be codified, and the document will need to be forwarded to the employer. In other words, you will no longer be able to arrange for the resignation by simply signing a resignation letter/agreement on paper.

Please notify your employees that in case of resignation they will need to:

  1. Visit the website at www.Cliclavoro.gov.it.
  2. Enter their PIN code issued by the INPS (SS authority).
  3. Access and populate the online form for filing notification.
  4. Send the form to you, the employer, and to the competent local employment office.

As soon as you have the filing, submit it to your payroll provider.
